7.1. Obligations. Each Party ("Recipient") shall protect the Confidential Information of the other Party ("Discloser") using the same degree of care used to protect its own proprietary information of like importance, but in no case less than a reasonable degree of care. Recipient may use Confidential Information only for purposes of this Agreement and may disclose it only to employees and contractors with a need to know who are bound by written confidentiality obligations at least as protective as those herein.
7.2. Exclusions. Confidential Information does not include information that: (i) is in Recipient's possession without restriction at the time of disclosure; (ii) becomes publicly known through no wrongful act of Recipient; (iii) is received from a third party free to disclose it without obligation to Discloser; or (iv) is independently developed by Recipient without reference to Discloser's Confidential Information.

Client's sole and exclusive remedy for breach of the foregoing warranty shall be, at CDPHub's option, re-performance of the deficient Services or a refund of fees paid for the deficient portion of Services.
9.3. Disclaimer. EXCEPT FOR THE REPRESENTATIONS AND WARRANTIES SET FORTH IN THIS SECTION 9, CDPHUB AND ITS AFFILIATES MAKE NO OTHER REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 15.8. Force Majeure. Neither Party shall be liable for failure to perform its obligations (other than payment obligations) due to causes beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, or disruptions to Internet infrastructure, provided that the affected Party gives prompt notice and uses reasonable efforts to mitigate the impact.
